14th Amendment Section 1 to the Constitution of the United States:
“All persons born or naturalized in the United States, and subject to the
jurisdiction thereof, are citizens of the United States and of the state wherein
they reside. No state shall make or enforce any law which shall abridge the
privileges or immunities of citizens of the United States; nor shall any state
deprive any person of life, liberty, or property, without due process of law;
nor deny to any person within its jurisdiction the equal protection of the
laws.”
“Birth Right Citizenship” relies on the first sentence and is very clear but
let’s take it apart piece by piece. What this sentence is doing is defining who
is and who is not a citizen of the United States. The first phrase identifies
“All persons born or naturalized in the United States…” Pretty clear and no
other groups are listed. But either of those groups (born or naturalized) are
also qualified by the phrase “…and subject to the jurisdiction thereof, …” So,
whether you’re born here or naturalized in the United States, you must also be
“under the jurisdiction” of the United States. Who is under the jurisdiction of
the United States? Illegal aliens are not under the jurisdiction of the United
States. They are here illegally. They are not supposed to be here by definition.
They are not "under the jurisdiction of" the United States just like
all of the rest of the world who are not here. If they were not here
illegally, their child would not have been born here and therefore, anyone born
to an illegal alien in the United States is not “subject to the jurisdiction thereof,..”
and does not qualify as a citizen of the United States. If we don't
consider a child born in the United States to a foreign diplomat a citizen of
the United States, why would we consider a child born here to an illegal alien
to be a citizen? It does not
take an amendment to the Constitution or legislative action or a Presidential
Directive to stop “Birth Right Citizenship”. It is not legal, should never have
been authorized and should stop immediately.
